These Terms and Conditions are between Ezy Applications Inc Trading as EzyZone a registered Vanuatu International Corporation and you "The Affiliate" or you "The Preferred Customer" :
Term and condition 1 - Age
(1) This Site is intended solely for Affiliates or Preferred Customers who are thirteen (13) years of age or older. Any registration by, use of or access to the Site by anyone under 13 is unauthorized, unlicensed and in violation of these Terms of Use.
(2) By using the products or services of the Site, you represent and warrant that you are 13 or older and that you agree to abide by all of the terms and conditions of this Agreement.
(3) We recommend that children Between the Ages of 13 and 18 ask their parents for permission before sending any information about themselves to anyone over the Internet.
(1) The Affiliate or Preferred Customer hereby accepts responsibility for keeping your information secure, private and records of all transactions the Affiliate or Preferred Customer makes within EzyZone. EzyZone protects all records, transactions and information by providing the maximum security we can on EzyZone servers.
(2) EzyZone will take all reasonable steps to safeguard servers and the data contained therein, however EzyZone will not be responsible for any loss of Affiliate or Preferred Customer data stored or intended to be stored on the EzyZone servers or other back up devices and the Affiliate or Preferred Customer will not be entitled to any form of compensation from EzyZone in the event of data loss.

Term and condition 3 - Transactions, charges and payments
(1) All transactions related to any of the EzyZone products and services will be deemed final. In the event of any dispute, such dispute must be emailed using our support link at http://support.ezyzone.com . It will be investigated and resolved via the terms, conditions, and regulations of EzyZone.
(2) The Affiliate or Preferred Customer will pay the charges for the products or services at the rate and in the manner specified on the EzyZone Web Site or as otherwise agreed between the parties in writing ONLY.
(3) The charges will be based on prices specified in the price list located on the EzyZone Web Site, or as provided in the written quotation and current from time to time.
(4) In the event that:
(1) EzyZone is required to provide the products or Services in circumstances other than those expressly or reasonably anticipated; or
(2) There is a change in the timing or complexity of the Products or Services; and such circumstances are not the result of a breach of this Agreement by EzyZone, then EzyZone will notify the Affiliate or Preferred Customer of any additional fees payable by the Affiliate or Preferred Customer as a result of such changes.
Payment of the Charges will be due in advance of provision of the Products or Services unless otherwise agreed by EzyZone in writing.
(5) EzyZone reserves the right to charge the Affiliate or Preferred Customer interest on any outstanding amounts under this Agreement.
(7) Late payments are subject to a late payment charge at a rate of 5% per month, compounded monthly, to the extent permitted by law. Where such rate is not permitted by law, the late payment charge shall be reduced to the highest rate permitted by law. Without prejudice to our other rights and remedies, in the event that you fail to pay sums due under this Agreement by 30 days after the due date, we may suspend the provision of the Products or Services. Upon such suspension, we will charge you a reactivation fee of $250 for reinstatement of the products or Services.
(8) All EzyZone EzyBit purchases will be charged in the name of Ezy Applications Inc. Ezy Applications Inc owns EzyZone and all Copyrights. Ezy Application Inc is trading as EzyZone.
(9) Ezy Applications Inc (Company Number 34608) is a Vanuatu International Corporation registered with the Vanuatu Financial Services Commission in the Republic of Vanuatu.
(10) Ezy Applications Inc Trading as EzyZone domicile Country is Vanuatu.
(11) All Payments are made in US Dollars (USD) unless otherwise stipulated on this site.
(12) EzyBits are available to setup and use after payment is made. Once payment has been made, The Affiliate or Preferred Customer will be directed via site instructions and email confirmation how to setup and use The Affiliate or Preferred Customer EzyBit purchase. If The Affiliate or Preferred Customer does not receive confirmation on the site or via email within 24hrs of your payment, please contact the EzyZone Support Team . We recommend The Affiliate or Preferred Customer print or write down the confirmation details of your purchase immediately payment is made.

Term and condition 4 - Taxation and legal advice
(1) The Affiliate or Preferred Customer confirms that EzyZone have not at any time, past or present, given The Affiliate or Preferred Customer any investment, legal, or tax advice, or at anytime has EzyZone promised or implicated of any financial gain to The Affiliate or Preferred Customer or the Affiliate or Preferred Customer's entity.
(2) The Affiliate or Preferred Customer accepts sole responsibility for any and all appropriate taxes as charged within the Affiliate or Preferred Customer's country and hereby indemnify EzyZone and its owners of such a liability.
(3) The Affiliate or Preferred Customer agrees that The Affiliate or Preferred Customer has been advised to consult your own legal counsel and accountant in regards to tax, financial, accounting, legal, and related matters.
(4) The Affiliate or Preferred Customer agrees that EzyZone and its owners have fully disclosed that EzyZone is not a licensed security trader, licensed securities broker, government employee, attorney, bank officer, CPA, or a certified financial planner, and that actions from The Affiliate or Preferred Customer are conducted at the Affiliate or Preferred Customer's own free will.

Term and condition 5 - Source of Funds
(1) As a Affiliate or Preferred Customer of EzyZone, The Affiliate or Preferred Customer agrees that any payment of products and services to EzyZone are free from any and all tax, imposts, levies, duties, charges, liens or encumbrances of any nature whatsoever, and are under your control and discretion, and are immediately available. The Affiliate or Preferred Customer also agrees that the Affiliate or Preferred Customer's funds are good, clear and legally earned or obtained, and of non-criminal origin.
Term and condition 6 - Cancellation
(1) Any EzyZone Affiliate or Preferred Customer can cancel or terminate the account at any time and without any notice. Any Affiliate or Preferred Customer who wishes to cancel the account will be dealt on the same basis as term and condition 17 "Minor termination". EzyZone or any of the management reserves the right to "terminate with immediate effect and without notice", should any Affiliate or Preferred Customer be in breach of these terms and conditions. Please see Term and condition 17 "termination".
Term and condition 7 - Invitation
(1) EzyZone is available to the general public via an invitation from one of the current registered Affiliates via the Affiliate's website link in the EzyZone Administration. EzyZone Affiliates is available to Free Zoner's ONLY who have supplied the appropriate information under term and condition 22 "due diligence", are accepted under term and condition 12 "acceptance" and have been invited via term and condition 23 "inviting others to participate". An EzyZone Affiliateship is free to join and complete the above steps. Once the EzyZone Affiliateship is accepted, various Affiliateship terms and conditions are required to be met in order for a Affiliate to earn a commission payment. Please refer to the EzyZone Affiliateship Terms and Conditions. Each commision payment is deemed to be a payment between EzyZone, its owners and the registered Affiliate for products or services purchased.
Term and condition 8 - Products or services
(1) The Affiliate or Preferred Customer agrees that the contemplated purchase of products or services from EzyZone is strictly one of private sale and the contemplated transaction does not rely upon or relate to the United States Securities Act of 1933 as amended or related regulations, the Securities and Futures Commission in Hong Kong, or Section 57 of the Financial Services Act 1986 (the "FSA") in the United Kingdom, and does not involve the sale of securities.
Term and condition 9 - Information
(1) The Affiliate or Preferred Customer hereby agrees that all information, communication and material coming from or contained within EzyZone is unsolicited. The Affiliate or Preferred Customer agrees that The Affiliate or Preferred Customer has requested information from EzyZone by The Affiliate or Preferred Customer's own free will and that EzyZone has not solicited The Affiliate or Preferred Customer in any way.
(2) The information, communication and material contained within this website are not to be regarded as an offer or a solicitation for investments in any jurisdiction.
Term and condition 10 - Liability
(1) The Affiliate or Preferred Customer agrees to indemnify and relinquish all principals and registered Affiliate or Preferred Customers harmless of any liability. The Affiliate or Preferred Customer is purchasing products and services with EzyZone Partners at your own risk and agrees that past performance is not an explicit guarantee for the same future performance. The Affiliate or Preferred Customer agrees that all information, communication and material The Affiliate or Preferred Customer will find on this website are intended to be regarded as an informational and educational matter and not investment advice.
(2) The Affiliate or Preferred Customer agrees that to the fact that The Affiliate or Preferred Customer is not seeking out evidence which may serve as the basis for any charge of violating any laws or regulations of any nation or government. The Affiliate or Preferred Customer also declares that no aspect of this transaction has been or will be used as the basis for any charge of violating any laws or regulations of any nation or government. In doing so, The Affiliate or Preferred Customer also relinquishes EzyZone and all associated parties from any criminal or civil liabilities and/or penalties as well as any losses incurred by The Affiliate or Preferred Customer or the Affiliate or Preferred Customer's entity.
Term and condition 11 - Change
(1) EzyZone reserve the right to change the terms and conditions, commissions, rates, periods and any other financial information of EzyZone and the products and services at any time and at the sole discretion and without prior notice. This is done to respect the integrity and security of the Affiliate or Preferred Customer's interests, the system, EzyZone and its owners. The Affiliate or Preferred Customer agrees that it is your sole responsibility to review current or updates to any terms or conditions.
Term and condition 12 - Acceptance
(1) EzyZone reserves the right to accept or decline any Affiliate or Preferred Customer registration. In the event of such Affiliate or Preferred Customer having conducted the purchase of products or services with EzyZone, the products or services will either be accepted or be dealt with in accordance to the term and conditions governing EzyZone. Declined Affiliate or Preferred Customer/s registration will be dealt with in accordance to term and condition 17 "minor termination".
Term and condition 13 - Communication
(1) EzyZone offer various methods of communication and a fully staffed online support team to handle questions and queries of all Affiliate or Preferred Customer. It is the Affiliate or Preferred Customer's responsibility to keep communication channels open and to keep The Affiliate or Preferred Customer's messages within such communication channels honest, clean, respectable and positive. Emails sent from EzyZone can be blocked by filters, resulting in a lack of communication. EzyZone will also communicate to The Affiliate or Preferred Customer via an online support announcement section - and online announcements (if logged in). Term and condition 14 - Publicity
(1) EzyZone will not tolerate or accept any bad publicity of any nature, from anyone whatsoever. The posting of information in any "media" source about EzyZone, its owners and staff must be kept appropriate and in line with the terms, term and conditions and regulations of this site.
(2) If The Affiliate or Preferred Customer publicly release any of the information contained within this website The Affiliate or Preferred Customer will be terminated from EzyZone - see term and conditions 17 "major termination", term and condition 18 "legal action". If The Affiliate or Preferred Customer posts information via term and condition 16 "media" about EzyZone, its owners and staff, EzyZone will use whatever means necessary to track The Affiliate or Preferred Customer down and prosecute The Affiliate or Preferred Customer. EzyZone will contact the owner of media source with a court order via an attorney. EzyZone will immediately hand all The Affiliate or Preferred Customer's contact details including all the information that The Affiliate or Preferred Customer forwarded to EzyZone via term and condition 22 "due diligence" process to the EzyZone attorney to start immediate legal action. EzyZone will terminate the account as per term and condition 17 "major Termination".
Term and condition 15 - Confidential
(1) The Affiliate or Preferred Customer agrees that The Affiliate or Preferred Customer has requested of EzyZone specific information and documentation by becoming a Affiliate or Preferred Customer. Any information EzyZone provides to The Affiliate or Preferred Customer is for The Affiliate or Preferred Customer's interest and purposes only. The Affiliate or Preferred Customer agree to keep all information received from EzyZone strictly confidential and shall not disclose any of it to any third party.
(2) "Confidential Information" shall be deemed to be but is not limited to all information, data, calculations, computer programs and software facilities, structures, projects, EzyZone Private transactions information, facilities and programs, relationships, contacts, buyers and sellers, agents, consultants, clients, customers, intermediaries, banks, trusts, addresses, telephone numbers, facsimile numbers, telex numbers, e-mail, Internet access addresses, or other means of communication, and includes, bank information, transaction codes and references, bank coordinates, borrower and lender identification, business, trusts, corporations, groups, individuals, partners, owners, brokers, terms and conditions, provisions and essential operation of all discussion, letters, faxes, memoranda, documents, contracts, leases, bank instruments, licenses, permits, privileges of any nature or kind which has been or will be disclosed, or discovered directly or indirectly by EzyZone or The Affiliate or Preferred Customer or The Affiliate or Preferred Customer's entity.
(3) The information between The Affiliate or Preferred Customer and EzyZone shall remain confidential at all times, and no time now or at anytime in the future shall The Affiliate or Preferred Customer share of the EzyZone program secrets without gaining permission from the owner first. The information is the sole property of EzyZone whose disclosure shall be at his/her discretion. The Affiliate or Preferred Customer also agree that should any information and passing of said information to certain parties, resulting in a loss to EzyZone in any way, the member/s and any and all parties utilizing the Information shall be severely and wholly liable for such loss to EzyZone and that term and condition 17 "Termination" and term and condition 18 " legal action" will be used against the said Affiliate or Preferred Customer.

Term and condition 16 - Media
(1) Definition: Channels of communication, either electronic or print, that serves mass or targeted audiences. Media -- transmissions that are disseminated widely to the public. Media includes: broadcasting, electronic media, information media, print media, magazines, newspapers, any form advertisement, poster, bulletin boards, notice boards, flyers, business cards, signatures, signature files, press, radio, television, website, forum, computer programs or software, internet cafe, facilities, mail, telephone, facsimile, telex, e-mail, Internet, groups, letters, faxes, memoranda, documents, any form of telecommunications, electronic journalism, journalism, broadcast journalism, print journalism, public print, music, mobile & stationary signage, photos, video, recorded call lines, private conference call lines, newsletters, mailing lists or any variation of the above. Media includes any way that any person can communicate with another person.
Term and condition 17 - Termination
(1) General Termination of Service:
(1) The Affiliate or Preferred Customer may cancel or terminate the Products and Services at any time.
(2) The Affiliate or Preferred Customer shall not be entitled to any partial or whole reimbursement for products and services of any fees or payments paid or due upon termination.
(3) The Affiliate or Preferred Customer is required to send a cancellation request to the Billing Department and provide at least the account name and the email address, no later than two business days prior to the recurring date.
(4) EzyZone reserves the right to terminate the Products and Services in the event of not receiving a payment or a recurring payment.
(5) EzyZone reserves at its sole discretion the right to instantly terminate the Products and Services in the event that:
(1) the Customer is conducting spam activities, or
(2) any abusive or illegal practices, as mentioned in Sections 3, 4, 5 above, or
(3) the Affiliate or Preferred Customer does not conform to any of their obligations as referred to Legal agreements of EzyZone.
(6) EzyZone reserves the right to terminate the Products and Services in the event of receiving verification that the Affiliate or Preferred Customer provided grossly inaccurate, unreliable or false registrant contact details, or failed to keep such contact details up to date.
(7) In any of the aforementioned instances, the Products and Services will be terminated with immediate effect. Any payments made for the Affiliate or Preferred Customer will not be reimbursed. The Affiliate or Preferred Customer shall not have any right for reimbursement of the sum paid.
(8) After terminating the EzyZone account the Affiliate or Preferred Customer shall no longer have an ability to; send broadcast messages to EzyZone Affiliates or Preferred Customers, have an ability to view and process their Affiliate or Preferred Customer contact details, have an ability to participate in conferences and send conference invitations to EzyZone Affiliate or Preferred Customer. All EzyZone features shall be disabled and the Affiliate or Preferred Customer's individual UZN site shall be disabled.
(9) EzyZone will not tolerate anyone who breaks the term and conditions and regulations of EzyZone. Please contact our customer service department to avoid breaking any of the term and conditions and guidelines associated with EzyZone. Support is available at http://support.ezyzone.com.
(10) We have a "No second chance policy". These term and conditions and regulations are in place to protect every Affiliate or Preferred Customer. We will not tolerate any Affiliate or Preferred Customer who breaks any of the term and conditions and will follow through with either "minor or major termination".
(11) If EzyZone finds a Affiliate to be in violation of the provisions herein, EzyZone reserves the right to terminate Affiliate participation in the EzyZone Affiliateship and forfeit all outstanding Affiliate Commissions and bonuses arising from the EzyZone Affiliate Compensation Plan. EzyZone reserves the right to immediately terminate the EzyZone products and services, as well as the EzyZone Affiliateship in the event of finding a Affiliate to be using the EzyZone Products and services in any unlawful ways.
(12) Once a Affiliate or Preferred Customer terminates his or her participation in EzyZone his or her Member UZN account will be closed and no longer exist. No additional commission and other bonuses shall be calculated upon the termination of the Affiliate account. If the Affiliate or Preferred Customer chooses to re-apply, he or she will be placed at the bottom of the enroller's network organization.
(2) Minor Termination.
(1) Minor termination occurs when The Affiliate or Preferred Customer breaches the terms and conditions as set out. The Affiliate or Preferred Customer account will be closed immediately and the Affiliate or Preferred Customer will no longer be allowed to hold an account with EzyZone in the future.
(3) Major Termination.
(1) Major termination occurs when The Affiliate or Preferred Customer breaches the "publicity" term and condition 14 or seriously breaches any of the term and conditions within.
Any payment within EzyZone will be immediately forfeited. The Affiliate or Preferred Customer will be liable for all legal costs associated with The Affiliate or Preferred Customer's actions and EzyZone will forward all The Affiliate or Preferred Customer's details to the EzyZone attorney to proceed with the necessary action to recover costs.
(2) EzyZone will immediately hand all The Affiliate or Preferred Customer's contact details including all the information that The Affiliate or Preferred Customer forwarded to EzyZone in the due diligence process to the EzyZone attorney to start immediate legal action.
Legal Action. EzyZone will not tolerate any breach of the terms and conditions set out within and will forward the breach of the term and condition along with the Affiliate or Preferred Customer information as per term and condition 22 to the company attorney to take the appropriate action to resolve the matter.
(1) Local Legal issues. IMPORTANT:
(1) As a Affiliate or Preferred Customer of EzyZone, The Affiliate or Preferred Customer agrees that the requested products, services and business transactions will not violate any federal, state, or local laws, regulations, or community standard, and The Affiliate or Preferred Customer also agrees to bear the full, complete, and sole responsibility for bringing such material into The Affiliate or Preferred Customer's local community. It is the responsibility of you the Affiliate or Preferred Customerto follow the rules and regulations in the country you reside.
(2) EzyZone will not tolerate anyone that conducts any illegitimate activities as a Affiliate or Preferred Customer. Any Affiliate or Preferred Customer that conducts illegitimate activities as a Affiliate or Preferred Customer, will have their account terminated under this term and condition (18).
(2) Legal Covenants.
(1) The Affiliate or Preferred Customer affirms that this document is a binding terms and conditions between EzyZone and The Affiliate or Preferred Customer. All sections herein shall conform to the International Chambers of Commerce (ICC) Term and conditions and Regulations, latest edition.
(2) The Affiliate or Preferred Customer confirms that this documentation revokes, discharges, and supersedes all prior representation including warranties or terms and conditions, written or oral, between The Affiliate or Preferred Customer and EzyZone concerning the subject matter of this document, except as specifically set forth herein.
(3) The Affiliate or Preferred Customer agrees that The Affiliate or Preferred Customer has been given the opportunity to independently review the terms and conditions with legal council and/or has the requisite experience and sophistication to understand, interpret, and agree to the term and conditions and regulations set out by EzyZone.
(4) The Affiliate or Preferred Customer agrees that The Affiliate or Preferred Customer has entered into these terms and conditions at The Affiliate or Preferred Customer's own free will and at no time has The Affiliate or Preferred Customer been circumvented into any terms and conditions within EzyZone.
(5) It is agreed that any documents as necessary, duly signed by The Affiliate or Preferred Customer or The Affiliate or Preferred Customer's entity are deemed effective and legally binding as a delivered original. This Affidavit may be signed in several counterparts, each of which shall be deemed an original and may be transmitted by email only as per term and condition 22 "Due diligence".
(6) The Affiliate or Preferred Customer confirms that with The Affiliate or Preferred Customer's ticking the agreement boxes on the website's registration and login forms that all corporations, organizations, companies, or individuals of which The Affiliate or Preferred Customer is a part, or who would financially benefit from this association, are bound by these terms and conditions and regulations.
Term and condition 19 - License
(1) The license you the Affiliate or Preferred Customer grant to EzyZone is non-exclusive. Affiliate or Preferred Customer are free to license Content to anyone else in addition to EzyZone. This license is royalty-free meaning that EzyZone is not required to pay the Affiliate or Preferred Customer for the use on the EzyZone Services of the Content that the Affiliate or Preferred Customer post. This license is sub-licensable so that EzyZone is able to use its affiliates, subcontractors or partners to provide the EzyZone Services. This license is worldwide because the Internet and the EzyZone Services are global in reach.
(2) The EzyZone Services contain Content of Affiliates or Preferred Customers and other EzyZone licensors. Except as provided within this Agreement, Affiliate or Preferred Customers may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the EzyZone Services.
(3) EzyZone does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials that Affiliate or Preferred Customers post on the EzyZone website or through the EzyZone services.
(4) After posting Affiliate or Preferred Customer Content to EzyZone, Affiliate or Preferred Customers continue to retain any such rights that Affiliate or Preferred Customers may have in the Affiliate or Preferred Customer Content, subject to the limited license herein. By displaying or publishing any Content on or through the EzyZone Services, Affiliate or Preferred Customers hereby grant to EzyZone a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Content solely on or through the EzyZone Services. This includes without limitation distributing part or all of the EzyZone Website in any media formats and through any media channels, except Content marked "private" which will not be distributed outside the EzyZone Website. This limited license does not grant EzyZone the right to sell or otherwise distribute Affiliate or Preferred Customer Content outside of the EzyZone Services.
(5) When Affiliate or Preferred Customers enter content to EzyZone Affiliate or Preferred Customers represent, warrant and covenant that the Affiliate or Preferred Customer owns the Content posted by the Affiliate or Preferred Customer on or through the EzyZone Services or otherwise have the right to grant the license set forth that the posting of the Content on or through the EzyZone Services does not violate any applicable laws, including but not limited to the privacy rights, publicity rights, intellectual property rights, copyrights, contract rights or any other rights of any person or entity. The Affiliate or Preferred Customer agree to pay for all royalties, fees, and any other monies owing to any person or entity by reason of any Content posted by the Affiliate or Preferred Customer on or through the EzyZone Services.
(6) The EzyZone Services contain Content of EzyZone. EzyZone Content is protected by copyright, trademark, patent, trade secret, industrial secret, and other laws, and EzyZone owns and retains all rights in the EzyZone Content and the EzyZone Services. EzyZone hereby grants the Affiliate or Preferred Customer a limited, revocable, non sub-licensable license to reproduce and display the EzyZone Content. This limited license excludes any software code and is solely for the Affiliate or Preferred Customer personal use in connection with viewing the EzyZone Website and using the EzyZone Services.
Term and condition 20 - Content
(1) The Affiliate or Preferred Customer are solely responsible for ensuring that all Content that the Affiliate or Preferred Customer post on or through any of the EzyZone Services, and any material or information that the Affiliate or Preferred Customer transmit to other Users, conforms to all applicable data protection and privacy laws, including ensuring that the Affiliate or Preferred Customer have obtained the prior consent of any and all individuals whose personal information the Affiliate or Preferred Customer use and/or disclose on or through EzyZone.
(2) EzyZone may reject, refuse to post or delete any Content for any or no reason. This includes Content that in the sole judgment of EzyZone violates this Agreement or which may be offensive, illegal or violates the rights of any person or entity, or harm or threatens the safety of any person or entity.
(3) EzyZone assumes no responsibility for monitoring the EzyZone Services for inappropriate Content or conduct.
(4) The Affiliate or Preferred Customer are solely responsible for the Content that the Affiliate or Preferred Customer post on or through any of the EzyZone Services, and any material or information that the Affiliate or Preferred Customer transmit to other Affiliate or Preferred Customers and for your interactions with other Affiliate or Preferred Customers.
(5) EzyZone may include various forums, blogs and chat rooms where the Affiliate or Preferred Customer can post the Affiliate or Preferred Customers observations and comments on designated topics. EzyZone cannot guarantee that other Affiliate or Preferred Customer will not use the ideas and information that Affiliate or Preferred Customers share. Therefore, if the Affiliate or Preferred Customer have an idea or information that the Affiliate or Preferred Customer would like to keep confidential and/or don't want others to use, do not post it on the Service.
(6) EzyZone reserves the right to investigate and take appropriate legal action against anyone who, in EzyZone's sole discretion, violates these provisions, including without limitation, removing the offending Content from the EzyZone Services and terminating the Membership of such violators. Prohibited Content includes, but is not limited to content that, in the sole discretion of EzyZone:
(1) Is patently offensive and promotes racism, bigotry and hatred or physical harm of any kind against any group or individual;
(2) Harasses or advocates harassment of another person;
(3) Exploits people in a sexual or violent manner;
(4) Contains nudity, excessive violence, or offensive subject matter or contains a link to an adult website;
(5) Solicits personal information from anyone under 18;
(6) Publicly posts information that poses or creates a privacy or security risk to any person;
(7) Constitutes or promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
(8) Constitutes or promotes an illegal or unauthorized copy of another person's copyrighted work;
(9) Involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging or "spamming";
(10) Contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
(11) Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
(12) Solicits passwords or personal identifying information for commercial or unlawful purposes from other Affiliate or Preferred Customers;
(13) Involves commercial activities and/or sales without prior written consent from EzyZone such as contests, sweepstakes, barter, advertising, or pyramid schemes;
(14) Includes a photograph or video of another person that the Affiliate or Preferred Customer have posted without that Affiliate or Preferred Customer's consent;
(15) For band, comedy, filmmaker and other profiles, uses sexually suggestive imagery or any other unfair, misleading or deceptive Content intended to draw traffic to the profile;
(16) Violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person; or
(17) Promotes propaganda and/or symbols of organizations which are unconstitutional or illegal in your country.
(7) The following are examples of the kind of activity that is illegal or prohibited on the EzyZone Website and through your use of the EzyZone Services. EzyZone reserves the right to investigate and take appropriate legal action against anyone who, in EzyZone's sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to:
(1) Criminal or tortuous activity, including child pornography, corruption of minors, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, sending of viruses or other harmful files, intellectual property rights including but not limited to copyright, trademark and patent infringement, or theft of trade or industrial secrets;
(2) Advertising to, or solicitation of, any Affiliate or Preferred Customer to buy or sell any products or services through the unauthorized or impermissible use of the EzyZone Services.
(3) The Affiliate or Preferred Customer may not transmit any chain letters or junk email to other Affiliate or Preferred Customers. If you breach this Agreement and send unsolicited bulk email, instant messages or other unauthorized commercial communications of any kind through the EzyZone Services, the Affiliate or Preferred Customer acknowledge that the Affiliate or Preferred Customer will have caused substantial harm to EzyZone, but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, the Affiliate or Preferred Customer agrees to pay EzyZone USD $200 for each such unsolicited email or other unauthorized commercial communication the Affiliate or Preferred Customersend through the EzyZone Services;
(4) Circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of the EzyZone Services;
(5) Activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network;
(6) Covering or obscuring the banner advertisements on the Affiliate or Preferred Customer personal profile page, or any EzyZone page via HTML/CSS or any other means;
(7) Any automated use of the system, including but not limited to, using scripts to add friends or send comments or messages;
(8) Interfering with, disrupting, or creating an undue burden on the EzyZone Services or the networks or services connected to the EzyZone Services;
(9) Impersonating or attempting to impersonate another Affiliate or Preferred Customer, person or entity;
(10) Using the account, username, or password of another Affiliate or Preferred Customer at any time or disclosing your password to any third party or permitting any third party to access the Affiliate or Preferred Customer account;
(11) Selling or otherwise transferring the Affiliate or Preferred Customer profile;
(12) Using any information obtained from the EzyZone Services in order to harass, abuse, or harm another person or entity, or attempting to do the same;
(13) Using the EzyZone Services in a manner inconsistent with any and all applicable laws and regulations.
(1) Although EzyZone anticipate to keep EzyZone open to accept new participants for an unlimited time from date of launch for new invitations. EzyZone reserve the right to stop accepting new prospective Affiliates into EzyZone at any given time. Registered zoner's will have the option to conduct any purchases of products and services at any time thereafter.
Term and condition 22 - Affiliateship information
(1) A potential Affiliate needs to complete the EzyZone online information form to become a Affiliate and start using & sharing the EzyZone products or services. Please see Term and Condition 7 and Term and condition 12 for more information on Invitations and acceptance.
Term and condition 23 - Inviting others to participate
(1) PLEASE NOTE: We allow the use of Affiliate APPROVED URL'S and Affiliate approved emails for online advertising to promote EzyZone. One must be personally invited to become a Affiliate by someone who is already a verified/existing Affiliate. Please read all the rules, terms and conditions, general policies, disclaimer, confidentiality agreement, non-disclosure agreement and non-circumvent agreement before you share this opportunity with anyone.
(2) EzyZone Affiliateship is restricted to registered Affiliates only who have completed the appropriate information forms, are accepted and verified by EzyZone and have been officially invited to participate via the terms and conditions of EzyZone. If the potential Affiliate is not invited correctly via the terms and conditions, they will not be accepted.
(3) There are regulations and penalties for any Affiliate that does not follow the guidelines. Please read them often to keep up to date with your current requirements (you agree to these guidelines each time you enter this site. These guidelines are subject to frequent updating therefore please read them often).
(4) What can I say to a potential Affiliate?
You can read what you can say when you login to the Affiliates area in your EzyZone Administration area.
(5) In what way can I invite a potential Affiliate to join?
You either can, by email, in person, approved advertisement or by personal phone call, talk to prospective members that are friends, neighbours, relatives and business associates with whom you, the Affiliate, have a friendship or existing relationship and share the EzyZone website to the above. This includes opt in lists providing you can prove the opt in.
(6) Anyone caught SPAMMING will be terminated immediately NO EXCEPTIONS!
(7) If the invitational method is not on the list for inviting prospective members it means that EzyZone does not agree or allow the Affiliate to invite a prospective Affiliate in that manner and that the Affiliate will be breaching the terms and conditions of EzyZone and will be dealt with via term and condition 17 "termination" and term and condition 18 "legal action".
(8) If The Affiliate does not accept the General Term and Conditions, Affiliate Terms and conditions, General Policies and Disclaimer as the Terms of Service of being a Affiliate, The Affiliate is not to register or enter the EzyZone website.
(1) EzyZone must perform scheduled maintenance to servers from time to time. EzyZone will attempt to perform all scheduled maintenance at times which will affect the fewest Affiliate or Preferred Customers. If scheduled maintenance requires the service to be offline for more than 30 minutes we will notify at least 48 hours in advance of the maintenance via email.
(2) EzyZone may need to perform unscheduled maintenance. If unscheduled maintenance requires the Service to be offline for more than 30 minutes, we will notify via email after the maintenance has been completed.
(3) EzyZone will archive the Affiliate or Preferred Customer data onto backup mechanisms on a regular basis for the purposes of disaster recovery. In the event of equipment failure or data corruption, EzyZone will restore from the last known good archive. In the event of corruption of all of our archives, or in the event that an old archive is used to restore data, the Affiliate or Preferred Customer should be prepared to upload the Affiliate or Preferred Customer data to the Affiliate or Preferred Customer web site. EzyZone will not be liable for incomplete, out-of-date, corrupt or otherwise deficient Affiliate or Preferred Customer data recovered from our backups.
(4) The Service is provided by EzyZone from its data centres in Australia and overseas. EzyZone will determine in its absolute discretion from time to time the data centre location from which your Service is provided. EzyZone reserves the right to migrate the Affiliate or Preferred Customer web site to a new operating system platform if our operating system supplier ceases to provide support for the legacy operating system, or if the server from which the service is provided fails or, in EzyZone's opinion becomes unreliable. EzyZone will use reasonable endeavours to notify the Affiliate or Preferred Customer via the contact details in our database but does not take any responsibility for web site failure if the Affiliate or Preferred Customer have failed to keep the Affiliate or Preferred Customer contact details up-to-date or if the Affiliate or Preferred Customer have not checked the operation of the Affiliate or Preferred Customer web site post-migration and notified us of any required changes to the web site configuration.
(5) In contracting with EzyZone for the products or Services, the Affiliate or Preferred Customer obtains no rights to the hardware and other infrastructure and facilities used by EzyZone to deliver the Products or Service.

Term and condition 25 - Bandwidth
(1) The Affiliate or Preferred Customer's subscription to the products or Services covers permitted bandwidth (monthly transfer limit) as stated on the EzyZone Website.
(2) EzyZone reserves the right to:
(1) Monitor the customer's monthly bandwidth usage;
(2) Implement restrictions on available bandwidth in order to protect all products or Services using the EzyZone Servers when necessary; and
(3) Make additional charges for usage above the limit at the prevailing rate as stated on the EzyZone site.

Term and condition 26 - Intellectual Property Rights
(1) Other than the rights expressly granted to the Affiliate or Preferred Customer under this Agreement, the Affiliate or Preferred Customer have no right, title or interest in or to the Products and Services or any other information, data, software, code, material, hardware or content (Materials) developed, supplied or made available by EzyZone to the Affiliate or Preferred Customer under or in connection with this Agreement. All right title and interest (including all Intellectual Property Rights) in and to the Products and Services and the Materials are retained by EzyZone.
(2) From the Activation Date the Affiliate or Preferred Customer are granted a non-exclusive, non-transferable right and licence to access and use the EzyZone Products and Services in accordance with this Agreement.
(3) A standard Internet browser and Internet access are required in order for the Affiliate or Preferred Customer to be able to access and use the Products and Services pursuant to this Agreement. The Affiliate or Preferred Customer acknowledge and agree that EzyZone are not responsible for providing the Affiliate or Preferred Customer with such browser or internet access, or any hardware or equipment required to access the Products and Services.
(4) It may be appropriate or necessary to use third party software as part of the products and Services. Any such third party software is licensed to the Affiliate or Preferred Customer on and subject to the third party licence terms and conditions applicable to such software. The Affiliate or Preferred Customer agree to comply with any such terms and conditions as notified by EzyZone from time to time.
(5) The Products and Services are subject to the bandwidth, memory and disk space, and CPU time/usage limitations set out from time to time on the EzyZone website. Each FREE EzyZone UZN has an agreed bandwidth limit of 100MB Per month unless otherwise specified. Bandwidth is the amount of data transmitted to and from the Affiliate or Preferred Customer account (E-mail, UZN, and Website). EzyZone will make available the bandwidth utilization of each EzyZone UZN via the Affiliate or Preferred Customer's area.
(6) In the event that:
(1) The Affiliate or Preferred Customer bandwidth, memory or disk space or CPU usage exceeds those limitations, or
(2) Those limitations are not specified, but EzyZone consider in our sole discretion that your bandwidth, memory or disk space or CPU usage is excessive, or
(3) We require the Affiliate or Preferred Customer to reduce your relevant resource usage to the specified or (where not specified) an acceptable level;
(4) We will charge the Affiliate or Preferred Customer additional Fees. Fees for additional monthly allowance of bandwidth are $50 per 1GB per year, unless otherwise specified.

Term and condition 27 - Affiliate or Preferred Customer Obligations
(1) The Products and Services are provided to registered zoners, hereinafter referred to as the "Affiliate or Preferred Customer".
(2) The Affiliate or Preferred Customer may choose their UZN, login details and password, hereinafter referred to as the "login details". The Affiliate or Preferred Customer is responsible for maintaining the secrecy of their login details.
(3) On registering for the Products and Services, the Affiliate or Preferred Customer agrees to:
(1) Fill out the registration form with current, complete, and accurate data;
(2) Maintain and promptly update this data on an ongoing basis, as completely and accurately as possible;
(3) Choose an account type and EzyBits suitable;
(4) Pay in due time all the fees accrued to the use of the Products and Services;
(5) The EzyZone Terms and conditions stated herein, as well any other policy developed, published and formulated by EzyZone;
(6) Send, stream or transmit through the Product and Services only such content that they have full rights to use and publish on the Internet and that does not violate any state, national and international laws and regulations;
(7) Conform to the rules relating to the use of electronic means of communication in force in the country of the Multi-Affiliate or Preferred Customer's residence, as well as the international electronic rules including, but not limited to, the laws and regulations concerning sending out electronic messages, in particular commercial electronic messages (The CAN-SPAM Act of 2003) and processing of personal data.
(4) EzyZone accounts and all transactions concerning EzyZone EzyBits are governed by and concluded according to EzyZone's Terms and conditions. To become a EzyZone Member the Affiliate or Preferred Customer should accept and agree to EzyZone Terms and conditions along with other regulations provided by EzyZone.
(5) The Affiliate or Preferred Customer is solely responsible for the contents of their representation and all results of any misrepresentation in that matter.
(6) The Affiliate or Preferred Customer commits to the Anti-Spam Policy and appropriate law provisions regarding the processing of email addresses and other personal data. The Affiliate or Preferred Customer realizes that they are solely responsible for any actions or omissions related to the processing of personal data within the Service.
(7) All the content sent, streamed or transmitted through the Products and Services is submitted to recipients by the Affiliate or Preferred Customer, not by EzyZone. Any and all communication through the Products and Services is sent, streamed or transmitted between the Affiliate or Preferred Customer and their recipients. As a result, even though a certain recipient may have opted out from receiving communications from EzyZone, such a recipient may receive certain Product and Service-related emails sent by the Affiliate or Preferred Customer. In addition, EzyZone may send announcements and/or emails to the Affiliate or Preferred Customer's recipient in their name, as the Affiliate or Preferred Customer's agent, and at the Affiliate or Preferred Customer's request on their behalf. The Affiliate or Preferred Customer is solely responsible for such emails and the contents thereof.
(8) The Affiliate or Preferred Customerrealizes that they are solely responsible for the content sent, streamed or transmitted by means of the Service.
(9) The Affiliate or Preferred Customergives their expressed consent that in any one case, the size of a single stream uploaded into the Affiliate or Preferred Customer's Media account is less than 100 MB in size.
(10) The Affiliate or Preferred Customer gives their express consent to receive commercial information about products and services from EzyZone.
(11) The Affiliate or Preferred Customer expressly agrees that use of the Products and Services are at their sole risk and accepts the fact that the Products and Services are provided on an "as is" basis, without guarantees of any kind.
(12) The Affiliate or Preferred Customer may not use any hardware or software intended to damage or interfere with the proper and timely functioning of the Products and Services, or to surreptitiously intercept any system, data or personal information from the Service nor any website owned or controlled by EzyZone.
(13) The Affiliate or Preferred Customer may not take any action that imposes an unreasonable or disproportionately large load on the website network or other Service Provider service infrastructure.
(14) EzyZone reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel a Affiliate or Preferred Customer UZN at its sole discretion. EzyZone reserves the right to refuse with immediate effect any and all current or future use of the Products and Services to the Affiliate or Preferred Customer who intentionally or maliciously evades the obligations stated in these Terms and conditions or arising from custom and other best practices of conduct on the Internet.
(15) EzyZone reserves the right to issue a warning should the Affiliate or Preferred Customer be found spamming or using the Service for any abusive or illegal practices. Appropriate action, such as disabling the Affiliate or Preferred Customer's UZN account, terminating the Service, and/or reporting the Affiliate or Preferred Customer and the incident to the appropriate authorities shall be taken immediately should the Affiliate or Preferred Customer appear to perform or be performing such practices, despite the explicit warning.
